Migo Lingo Mobile App User Agreement

This User Agreement ("Agreement") governs the use of the Migo Lingo mobile application ("Application").

By downloading, installing, accessing, or using Migo Lingo, you agree to this Agreement. If you do not agree with these terms, please do not use the Application.

1. Purpose of the Application

Migo Lingo is a language-learning application designed to help users learn and practice foreign languages through educational activities and interactive features.

Depending on the platform, device, operating-system version, language, and Application version, features may include:

• Vocabulary learning and review

• Grammar learning and practice

• Pronunciation practice

• Speaking and listening exercises

• Reading activities

• Word and sentence exercises

• Interactive learning activities

• Stories and level-based learning content

• Text-to-Speech pronunciation

• AI-assisted language-learning practice

Migo Lingo is intended primarily for educational and foreign-language-learning purposes.

2. No User Account or Migo Lingo Backend

Migo Lingo does not require users to create an account.

Migo Lingo does not operate its own backend server, user-account database, or cloud storage service for storing users' learning progress or normal application data.

Information required to maintain normal Application functionality is generally stored locally on the user's device.

Locally stored information may include learning progress, completed lessons, scores, preferences, settings, favorite words, and other information necessary to maintain the user's local Application state.

Because Migo Lingo does not maintain a server-side account or learning database, this locally stored learning information is not uploaded to or stored on Migo Lingo's own servers.

Third-party services integrated into the Application may process certain information independently as described in the Migo Lingo Privacy Policy.

3. Local Data and Application Deletion

Information stored locally by the Application may be removed if the user deletes the Application, clears its data, resets the device, changes devices, or if the operating system otherwise removes Application data.

Migo Lingo does not maintain a server-side backup of locally stored learning progress.

Users are responsible for maintaining their device and local Application data.

To the maximum extent permitted by applicable law, Migo Lingo and its developer are not responsible for the loss or inability to recover locally stored data resulting from deletion of the Application, clearing Application data, device reset, device failure, operating-system actions, changing devices, or other events outside the developer's reasonable control.

4. AI Tutor

Migo Lingo may provide an optional AI Tutor designed to support foreign-language learning and practice.

Depending on the available features, the AI Tutor may assist with:

• Conversation practice

• Vocabulary practice

• Grammar practice and correction

• Sentence practice and correction

• Speaking and language practice

• Role-playing

• Everyday conversation scenarios

• Travel-related language practice

• Language practice appropriate to the user's selected level

The AI Tutor is an educational language-learning tool only.

It is not intended to replace a qualified teacher or professional advisor and must not be relied upon for medical, legal, financial, psychological, emergency, or other professional advice.

Generative AI can produce inaccurate, incomplete, inappropriate, or unexpected responses. Migo Lingo does not guarantee the accuracy, completeness, suitability, or reliability of AI-generated content.

Users should use their own judgment and should not rely on AI-generated information for decisions outside the purpose of language learning.

5. On-Device AI Processing

Migo Lingo is designed to use platform-provided on-device generative AI technologies for supported AI Tutor functionality.

iOS

On supported Apple devices and operating-system versions, Migo Lingo may use Apple's Foundation Models technology to provide AI Tutor functionality using an on-device model made available by the operating system.

Availability depends on Apple device compatibility, operating-system version, Apple Intelligence and Foundation Models availability, supported languages, system configuration, and other platform requirements.

Android

On supported Android devices and operating-system configurations, Migo Lingo may use Google's ML Kit GenAI Prompt API, powered by Gemini Nano through Android's on-device AI infrastructure, to provide AI Tutor functionality.

Availability depends on device compatibility, operating-system and system-service support, model availability, supported languages, Application version, and other platform requirements.

General

AI Tutor functionality is therefore not guaranteed to be available on every iOS or Android device.

For the on-device AI implementations described above, AI Tutor prompts and generated responses are processed using the supported on-device AI technology rather than being sent to a Migo Lingo-operated AI server.

Migo Lingo does not operate its own backend server for receiving or storing AI Tutor conversations.

AI Tutor conversation content may remain temporarily within the Application as necessary to display and continue an active conversation.

Platform providers may update their AI models, system services, supported devices, availability requirements, or technical behavior over time.

6. Sensitive Information and AI Tutor

Users should not provide sensitive, confidential, or unnecessary personal information to the AI Tutor.

Users should not enter information such as:

• Passwords or authentication credentials

• Banking or payment information

• Government identification numbers

• Private medical or health information

• Highly sensitive personal information

• Confidential business information

• Private information belonging to another person without permission

The AI Tutor should be used for language-learning practice rather than as a place to store or disclose sensitive information.

Users are responsible for information they voluntarily enter into the AI Tutor.

7. Microphone and Speech Recognition

Certain language-learning features may require access to the device's microphone or speech-recognition capabilities.

These features may include pronunciation practice, speaking exercises, and voice input.

Users control microphone and speech-recognition permissions through their device and operating-system settings.

Migo Lingo does not operate its own backend server for recording or storing users' microphone audio.

Speech recognition may be performed on the device or through speech-recognition functionality provided by the operating system or platform provider, depending on the device, operating system, language, system configuration, and technology being used.

Any independent processing performed by a platform or operating-system provider is subject to that provider's applicable terms and privacy practices.

8. Text-to-Speech

Migo Lingo may use Text-to-Speech technology provided by the user's device or operating system to pronounce words, sentences, and other learning content and to support pronunciation and listening practice.

Availability and voice quality may vary depending on the device, operating system, installed voices, language, and system configuration.

9. Advertising

Migo Lingo may display advertisements using third-party advertising services such as Google AdMob.

Advertising services may independently process certain device, advertising, diagnostic, interaction, or usage-related information as necessary to provide, measure, secure, or personalize advertising, depending on the user's device, settings, consent choices, region, applicable laws, and the configuration of the advertising service.

The fact that Migo Lingo does not operate its own backend for users' learning data does not mean that third-party services integrated into the Application cannot independently process information.

Additional information is provided in the Migo Lingo Privacy Policy and the applicable third-party privacy policies.

10. Appropriate Use

Users agree to use Migo Lingo for lawful and appropriate purposes.

Users must not intentionally use the Application or AI Tutor to:

• Engage in unlawful activity

• Harass, threaten, or abuse others

• Generate or distribute unlawful or harmful content

• Attempt to compromise Application or device security

• Interfere with the normal operation of the Application

• Circumvent technical restrictions or safeguards

• Misuse Application features

The AI Tutor is intended for language-learning activities and should not be used for professional advice or emergency situations.

11. Children's Use

Migo Lingo may be used by users of different ages, subject to applicable platform requirements, age ratings, local laws, and parental or guardian supervision where appropriate.

Parents and guardians are encouraged to supervise children's use of mobile applications and AI-assisted features and to review the Migo Lingo Privacy Policy and relevant platform privacy information.

Where required by applicable law or platform policy, Migo Lingo may apply additional protections, restrictions, consent mechanisms, or limitations relating to younger users.

12. Availability and Changes

Application functionality may vary depending on:

• Operating system

• Device capabilities

• Operating-system version

• Available on-device AI models

• Supported languages

• Region

• Application version

• Third-party and platform services

• Platform requirements

• Applicable laws and regulations

Certain AI Tutor functionality requires compatible on-device AI technology and therefore may not be available on all devices.

Features may be added, modified, limited, suspended, or removed in future versions of Migo Lingo.

13. Intellectual Property

Unless otherwise stated, Migo Lingo, its original Application content, design, software, branding, and related materials are owned by or licensed to the developer and are protected by applicable intellectual-property laws.

This Agreement does not grant users ownership of Migo Lingo or its intellectual property.

Users may use the Application for its intended personal and educational purposes subject to this Agreement and applicable law.

14. Disclaimer

Migo Lingo is provided primarily for educational and foreign-language-learning purposes.

The Application and its AI-assisted functionality are provided on an "as is" and "as available" basis to the extent permitted by applicable law.

Migo Lingo does not guarantee that learning content, translations, corrections, pronunciation-related results, AI-generated responses, or other information will always be accurate, complete, suitable, available, or error-free.

AI models may produce unexpected or incorrect output, and output may vary between devices, model versions, operating-system versions, and platforms.

AI-generated content must not be considered professional medical, legal, financial, psychological, emergency, or other professional advice.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for indirect, incidental, special, consequential, or similar losses arising from the use of or inability to use the Application, including loss of locally stored Application data, except where such liability cannot lawfully be excluded or limited.

Nothing in this Agreement is intended to exclude, restrict, or limit any rights, remedies, guarantees, or liabilities that cannot legally be excluded or limited under applicable law.

16. Third-Party Services

Certain Application functionality may depend on services, frameworks, SDKs, or technologies provided by third parties or platform providers.

These may include, depending on the platform and Application version:

• Apple Foundation Models

• Google ML Kit GenAI APIs and Gemini Nano

• Operating-system speech-recognition services

• Operating-system Text-to-Speech services

• Google AdMob

The availability and operation of these services may be governed by their providers' applicable terms, policies, technical requirements, and privacy practices.

17. Privacy Policy

Information about how Migo Lingo handles information and data is described in the Migo Lingo Privacy Policy.

Users are encouraged to review the Privacy Policy before using the Application and whenever it is updated.

18. Changes to This Agreement

This Agreement may be updated from time to time to reflect changes to Migo Lingo, its features, supported technologies, third-party services, legal requirements, or platform requirements.

Updated versions will be published together with an updated revision date.

Continued use of the Application following an update is subject to applicable law and the terms then in effect.
